Chapter 23 - Restoring
America's Original Republic with the Swiss Confederation Institute
Talking Points: How improved communications, the internet, and the
ease of travel make Switzerland’s decentralized direct democracy,
like America's first government under the Articles of Confederation,
worth considering again as the solution to many political problems
in America today. The history of Switzerland shows that this is the
best political system to limit government, advance liberty, and end
the control of special interests over the political process in the
United States.
Why
The Swiss Confederation Institute?
“The
people can never willfully betray their own interests; but they may
possibly be betrayed by representatives of the people.” -
The Federalist, No. 63
The Mission Statement reads as follows: We seek to promote a
return to limited government and maximum liberty in the USA and
around the world through decentralized confederation government
combined with direct democracy. Our American history shows that pure
representative democracy, although required during earlier times of
limited communications and travel, has often failed to preserve
liberty and limit the growth of government. It has also failed in
minimizing special interests control over government.
The Swiss Confederation Institute will educate the public on
the benefits of expanded direct democracy with the right of
referendum & initiative in order for the citizens to curtail or
introduce legislation and laws. We also favor the Swiss model of
decentralized, limited confederation government as exists in
Switzerland today and formerly in America's first government,
The Articles of Confederation
and later in the Constitution of the
Confederate States of America.
In addition, we advocate The Swiss concept of
“Willensnation,” a growth by attraction. Specifically, it is the
voluntary association of neighboring states, principalities, cities,
and individuals that makes Switzerland a nation created by acts of
the free will by voluntarily, peaceful, and democratic devolution
from other government structures. We believe many nations around the
world, including the United States of America, would do well to
emulate the successful Swiss example. Aggressive war, growing
religious extremism, terrorism, and ethnic and religious bigotry, as
well as the often heavy handed tyranny of majorities and special
interests, could be avoided and supplanted by the Swiss example of
direct democracy and confederation.
Our goal in the United States is to educate the public on the
benefits of a return to a decentralized, limited, confederation
style government similar to the Articles of Confederation, America's
government established by our patriot Founding Fathers. In addition,
we seek to promote Swiss style limited government around the world.
What
Would Our Founding Fathers Say To Americans Today
“Freedom is under attack all over the world, and America is now far
less free than it once was. We have reached a point where the level
of freedom we currently enjoy is not significantly more than what we
had when the Revolutionary War was fought. Religious freedom, though
still greater than before the founding of America, is under attack.
Taxes are high, and national and state debts are at all-time highs
and still growing. Virtually every American is numbered and will
soon be given ID's which put them in a de facto national database
("your papers please"). Property rights have been gutted in the last
couple of years. The list goes on and on. The prevailing attitude is
this: individual liberty is dead, even here in America”. -

When you think back to the Boston Tea Party and our
revolution against King George, let us look back at some of the
apparent injustices that caused the American Declaration of
Independence. Reading from The Declaration, you decide for yourself
if the quote by Varrin Swearingen above is on the mark.
The
history of the present King of Great Britain is a history of
repeated injuries and usurpations, all having in direct object the
establishment of an absolute Tyranny over these States. To prove
this, let Facts be submitted to a candid world.
–
Today, more than ever before, Washington has total power over and tyranny
over the individual states.
He has
refused his Assent to Laws, the most wholesome and necessary for the
public good.
–
Today, the majority of the American people want limits on
immigration through secure borders, an orderly withdrawal from Iraq,
prayer in schools, and numerous other laws and legislation. On the
other hand, Congress and the Executive Branch are unwilling to
follow the will of the people to enact such legislation.
He has
forbidden his Governors to pass Laws of immediate and pressing
importance, unless suspended in their operation till his Assent
should be obtained; and when so suspended, he has utterly neglected
to attend to them.

State laws and governors are superseded by federal authority on all
issues.
He has
refused to pass other Laws for the accommodation of large districts
of people, unless those people would relinquish the right of
Representation in the Legislature, a right inestimable to them and
formidable to tyrants only.

Special interest groups--not the people-- control our state
legislatures, as well as congress.
He has
called together legislative bodies at places unusual, uncomfortable,
and distant from the depository of their Public Records, for the
sole purpose of fatiguing them into compliance with his measures.
-
Today, distant Washington rules over states and individuals with an
iron fist.
He has
dissolved Representative Houses repeatedly, for opposing with manly
firmness his invasions on the rights of the people.
- Our
representatives at the local, state, and federal level subjugate
themselves to the will of the federal government. Moreover, I see
little "manly firmness" against federal invasions on the rights of
the people except by a few patriots like GOP Congressman Ron Paul of
Texas.
He has
refused for a long time, after such dissolutions, to cause others to
be elected, whereby the Legislative Powers, incapable of
Annihilation, have returned to the People at large for their
exercise; the State remaining in the mean time exposed to all the
dangers of invasion from without, and convulsions within.

Today, all states are exposed to invasion by illegal immigrants as
the Feds have totally failed in their responsibilities to secure our
nation's borders.
He has
endeavoured to prevent the population of these States; for that
purpose obstructing the Laws for Naturalization of Foreigners;
refusing to pass others to encourage their migrations hither, and
raising the conditions of new Appropriations of Lands.

Back then, we needed more immigration to the colonies, while today
we need immigration controls.
He has
obstructed the Administration of Justice by refusing his Assent to
Laws for establishing Judiciary Powers.

Today, we have too much judiciary power, and the people have no
control over the legal system. Rather, the Judicial powers are now
controlled by the legal profession and other special interests.
He has
made Judges dependent on his Will alone for the tenure of their
offices, and the amount and payment of their salaries.

Interestingly, we have the same problem with judges and the entire
legal system.
He has
erected a multitude of New Offices, and sent hither swarms of
Officers to harass our people and eat out their substance.

Today the problem is thousands of time worse.
He has
kept among us, in times of peace, Standing Armies without the
Consent of our legislatures.
- In
our time, the President can nationalize the State National Guard
troops and even send them to distant wars around the world without a
declaration of war.
He has
affected to render the Military independent of and superior to the
Civil Power.

Today, our military is not the problem inside the United States, but
rather the bureaucracy and those alphabet federal agencies with
unlimited police powers and authority.
He has
combined with others to subject us to a jurisdiction foreign to our
constitution, and unacknowledged by our laws; giving his Assent to
their Acts of pretended Legislation:

Whether we are dealing with the United Nations, or unelected
bureaucrats who create legislation at will without controls or
approval of the people, the U.S. Constitution is essentially dead.
Furthermore, like the Constitution, nonexistent are local and state
powers and authority, because all power is at the federal level.
For
quartering large bodies of armed troops among us:

Again, today we have to deal with all the armed federal agents and
organizations that threaten the liberty, privacy, and property of
every American.
For
protecting them, by a mock Trial from punishment for any Murders
which they should commit on the Inhabitants of these States:
-
Federal employees, agencies, and parasitical bureaucrats are
protected from suit or punishment by the citizens.
For
cutting off our Trade with all parts of the world:
-
Today, Americans are prohibited from trading with some rogue
nations. However, the real outrage is Washington's "Iron Curtain",
which prohibits non-registered investment firms and advisors from
providing investment information to prospects inside the United
States.
For
imposing Taxes on us without our Consent:
-
Again, today it is the same-- only thousands of times worse than
during Colonial times.
For
depriving us in many cases, of the benefit of Trial by Jury:
-
Since 9/11, this has gone out the window, not to mention the petty
fines and harassment from government agencies where we have little
or no opportunity for a fair trial by our peers.
For
transporting us beyond Seas to be tried for pretended offences:

This is primarily happening to proported Islamic terrorists who
happen to be US citizens, although this scary precedent means
regular American citizens could be next.
For
abolishing the free System of English Laws in a neighboring
Province, establishing therein an Arbitrary government, and
enlarging its Boundaries so as to render it at once an example and
fit instrument for introducing the same absolute rule into these
Colonies
Sound
like the United States to you? Me too.
For
taking away our Charters, abolishing our most valuable Laws and
altering fundamentally the Forms of our Governments:

Today, this is the situation in the US concerning state and local
laws and legislation that limits the federal government.
Our patriot Founding Fathers would not be reading this book
or complaining about the state of affairs today in the United States
of America. They would have declared their opposition, the
independence of the individual states, and seceded from the mess and
tyranny in Washington many decades ago. The fact that most citizens
complain but do nothing is why our nation is in the deep trouble it
is today.

It is quite sad to read the excerpts above from the Declaration
of Independence because it becomes quite clear that our Patriot
Founding Fathers had the courage and desire to stand up to a distant
empire that trampled on our rights and liberties while the majority
of the American people today do not, at least not yet. I believe
that events outside of our control will shake both the power and
control of Washington as well as the stupor of passivity and
cowardness that smothers the courage to stand up to those who have
brought the future of our nation to the precipice of political
failure and economic collapse.
The
coming collapse of the dollar, the destruction of our remaining
civil liberties and the failure of our controlled two-party system
will finally begin to rekindle the fires of resistance to tyranny
and incompetence by the special interests who lord over the American
people. When the time comes, we must not look ahead to tyranny and

Fathers. Our proud history will provide a guide to the future as
will the free nation of Switzerland will provide a modern day
example of the success of limited government and direct Switzerland.

Direct
Democracy in Switzerland
by Gregory Fossedal. If you decide to purchase only one book
recommended here, buy this book. Fossedal makes the best case why
Switzerland is unique in all the world with direct democracy and a
limited confederation government. This
is an important
analysis of Swiss democracy and a timely reminder that there is a
successful, peaceful, prosperous, democratic example and solution to
the ethnic, religious and political differences as well as foreign
policy objectives which does not involve big government at home or
aggressive military intervention around the world.

The
Articles of Confederation
by Merrill Jensen. I don't suppose one in ten Americans realize
there was a first constitution of the United States before there was
"the" Constitution of the United States. Merrill Jensen is the
definitive historian of that period - up to 1789 when the present
Constitution took effect - and this book is one of several of his
covering the topic. Reading of this period would do much to remind
Americans that the debate over the nature of American government has
been going on since 1776. The debate concerns "weak" central
government (the Articles of Confederation) vs. "strong" central
government (the Constitution). The Federalists (favoring the
Constitution) won politically, but their victory did not settle the
argument. Any American presidential or congressional election
campaign brings out the same themes sounded 200 years ago as the
Constitution faced ratification. In any event, Jensen does much to
rehabilitate the history of the Confederation, clarify the agruments,
and takes care to note the remarkable accomplishments of the
Confederation congress. His writing style is very accessible and the
